Sun Peaks Resort LLP (“Sun Peaks”) is committed to maintaining the security, confidentiality, and privacy of the personal information of all individuals with whom it has contact. This Privacy Policy documents the Sun Peaks commitment to you, whether you are a customer, supplier, guest, employee, or otherwise, and has been developed in compliance with the British Columbia Personal Information Protection Act (“PIPA”).
The Sun Peaks Privacy Policy addresses the collection, use and disclosure of personal information about identifiable individuals by Sun Peaks Resort and by trusted third parties and service partners. It applies to the information collected, used, or disclosed by us when you visit www.sunpeaksresort.com or store.sunpeaksresort.com, social media pages, use a mobile or online application, access onsite Wi-Fi service through a gateway, and when you participate in surveys, contests, or promotions, or visit any of our facilities.
Because PIPA does not impose any requirements on Sun Peaks regarding the collection, use, or disclosure of business contact information, or certain publicly available information, this Policy does not apply.

Some of the sites you visit may give you the option of sharing information about skiing or snowboarding experiences, feedback, or personal information. Sun Peaks is accountable and responsible for protecting your personal information in its possession or custody and will also take steps to require a comparable level of protection when the information is being processed or managed by a third party on behalf of Sun Peaks.

How Is Your Personal Information Used?

When you create an account on our website, we may request and collect your name, email, phone number, address, username, and password so we can maintain your account and our internal database. The information collected and maintained in the database includes: your name, email address, password, phone number, mailing address, your purchase history, and products. Sun Peaks will never share your data with anyone.
When you make a purchase online, we may collect personal information from you so we can complete the transaction, create your account, or process any refunds. Such information may include your name, date of birth, billing address, email, phone number, as well as payment information.
Sun Peaks will not disclose your personal information for purposes other than those for which it was collected, except with your consent or as required or authorized by law.
Sun Peaks discloses aggregate non-identifiable information (e.g., survey data, resort statistics and hotel statistics) to trusted third parties (e.g., Destination British Columbia or Tourism Sun Peaks) for industry analysis and promotional purposes.
Sun Peaks enters into contractual relationships with other resorts so our customers can access skiing, snowboarding, and other services at those resorts. To facilitate those services we may share your name and season pass number with the other resort company so they can validate your pass, identity and provide the service. We share that information pursuant to written contracts with the partner resorts and limit the information to what is needed for the specific purpose.
At times Sun Peaks may co-sponsor an event with a business partner or partners. We may disclose information to those business partners to help us market the event and associated products and services. Any information shared is pursuant to written contracts and limited to the specific purpose, including providing aggregate non-identifiable data when possible.
Sun Peaks will never sell your personal information to third parties.
By visiting www.sunpeaksresort.com or store.sunpeaksresort.com, you agree to the collection, storage, use, and disclosure of your personal information as defined in this Policy. Should you not consent to the collection of your personal information, you should not visit this site or provide any information when making a purchase at any sales location.
Sun Peaks will obtain your consent to collect, use or disclose personal information, except where Sun Peaks is authorized or required by law to do so without your consent. For example, Sun Peaks may collect, use, or disclose personal information without your knowledge or consent if the information is publicly available, Sun Peaks is obtaining legal advice, or Sun Peaks reasonably expects that obtaining consent would compromise an investigation or proceeding. Sun Peaks has implemented physical, technological, and organizational safeguards, and reasonable security measures designed to protect against unauthorized access, collection, misuse, copying, modification, loss, or disclosure of the personal information under our control. We also take measures to protect the personal information we disclose to third parties, for example by entering into contractual agreements stipulating the confidentiality of the information and the purposes for which it is to be used.
No security measures are impenetrable. You can help us by protecting and keeping your passwords safe at all times, and by not using the same password for different websites or applications. You can also protect yourself by notifying Sun Peaks if you suspect your credit card, pass product, username, or password is lost, stolen, or used without permission.
Note that confidentiality and security may not be assured when information is transmitted through email or wireless communication. Upon written request and authentication of your identity, Sun Peaks will respond with the requested personal information within 30 days or provide written notice when additional time is required to fulfill the request. Sun Peaks will inform you in advance of the cost to provide your information.

In some situations, Sun Peaks may not be able to provide you with access to certain personal information. This may be the case where, for example, disclosure would reveal personal information about another individual, the personal information is protected by solicitor/client privilege, the information was collected for the purpose of an investigation or where disclosure of the information would reveal confidential commercial information that, if disclosed, could harm the resort’s competitive position. Sun Peaks may also be prevented by law from providing access to certain personal information.
Where an access request is refused in whole or in part, Sun Peaks will notify you in writing, giving the reason for refusal and outlining further steps available to you.
